Respondents Writ Petition has been filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 1st respondent to conduct enquiry and dispose the petitioners appeal dated 19.11.2024 filed against the order passed by the 2nd respondent vide Moo.Mu.No.3537/2024/AA2 dated 16.10.2024. O R D E R
The limited prayer that is made in the writ petition is to dispose of the petitioner's appeal dated 19.11.2024. The second respondent had passed an order dated 16.10.2024 rejecting the representation of the petitioner with reference to the pipeline that passes through the petitioner's land.
2. The petitioner has a remedy of appeal before the first respondent, accordingly the above appeal is filed.
3. Mr.S.Balamurugan, Learned Government Advocate taking notice on behalf of the respondents 1 & 2 would submit that the earlier order itself is passed by the second respondent as per the direction of this Court to consider the representation. Be that as it may, when the petitioner has an appellate remedy, let the first respondent consider the appeal in the manner to law. 2/4
4. Accordingly, this writ petition is disposed on the following terms: The first respondent shall take up the appeal filed by the petitioner dated 19.11.2024. The petitioner shall also be heard in the matter and orders be passed in accordance with law within a period of 12 weeks from the date of receipt of the web copy of the order without waiting for the certified copy of the order. No costs.
