... Respondents Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents herein to pass appropriate orders on the petitioner's representation dated 21.03.2022 within the stipulated time. For Petitioner : Mr.M.Selvam For Respondents : Mr.P.Sathish Additional Government Pleader
ORDER
This writ petition has been filed seeking for issuance of a writ of Mandamus to direct the respondents herein to pass appropriate orders on the petitioner's representation dated 21.03.2022 within the stipulated time fixed by this Court.
2. The case of the petitioner is that petitioner's father one Govindan and his mother one Lakshmiammal are the owners of the property comprised in S.Nos.589/1, 589/2, 598/2, 589/3 and 599 respectively situated at Papinaickanahalli Village. Thereafter, they are in possession and enjoyment of the said property. While that being so, the said Govindan and Lakshmiammal died in the year 2006 and 2015 respectively leaving behind the legal heirs. Subsequently, the said lands have been acquired for the purpose of laying National Highways NH 844. Thereafter, an Award amount has been declared by the Government for the said land. In order to disburse the compensation declared by the Government to all the legal heirs of said Govindan and Lakshmiammal, petitioner made a representation to the respondents dated 21.03.2022. Since the same was not considered by the respondents, the petitioner has filed the present Writ Petition seeking the aforesaid relief.
3. Though very many grounds have been raised in this Writ Petition, learned counsel for the petitioner submits that it would suffice if this Court issues direction to the respondents to consider the petitioner's representation dated 21.03.2022 and pass orders on merits within a particular time frame to be fixed by this Court.
4. The learned Additional Government Pleader appearing for respondents submitted that the Award amount was deposited before the Subordinate Court, Dharmapuri, on 04.04.2022.
5. Heard the learned counsel appearing on either side and perused the materials placed before this Court.
6. In view of the fact that the award amount has been deposited before the Sub Court, Dharmapuri, the respondents are directed to give the details pertaining to the said deposit within a period of four weeks thereafter, the petitioner shall approach the Sub Court, Dharmapuri, for disbursement of compensation.
7. With the above observations, the Writ Petition is disposed of. No costs.
