Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to consider petitioners representation dated 22.12.2020 and direct the respondent police to conduct an enquiry and submit a report before this Honourable Court within a time frame fixed by this Court.

O R D E R

The prayer in the writ petition appears to be seemingly innocuous one to dispose of the representation of the petitioner. However, from the averments as it disclosed in the affidavit filed in support of the writ petition it appears that the writ petition is lacking any specific cause of action.

2. The averments in the affidavit about the so-called illegality committed by police personnel while imposing fines on him appears to be generic in nature and such averments are not clearly spelt out with unimpeachable material in order to sustain the writ petition under Article 226 of the Constitution of India. Even otherwise, there cannot be a direction of a nature that is sought by the petitioner at his instance, on the basis of the self-serving averments of the petitioner alone. In fact, no particular police personnel has been arrayed as party respondent in the writ petition, against whom the petitioner appears to have a grouse as being targeted illegally for https://hcservices.ecourts.gov.in/hcservices/

imposing fines on him on different occasions.

3. This Court is of the view that in case the petitioner has any specific grievance, it is open to him to approach the authority concerned and work out his remedy in the manner known to law, but it is certainly not open to him to invoke the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India.

4. Therefore, this Writ Petition stands dismissed. No costs.
