N.Janaki ...Defendant PRAYER: Plaint filed under Order IV Rule 1 of the Original Side Rules read with Order VII Rule 1 of Civil Procedure Code, praying to pass judgment and decree against the defendant:- i) directing the defendant to receive a sum of Rs.77,00,000/- after defraying with Tax deduction at source and execute sale deed in favour of the plaintiff and to deliver possession thereof in respect of the suit property within a period to be stipulated by this Court and in default, to have the same executed by process of law; and ii) ordering costs of the above suit.

J U D G M E N T

When the matter is taken up for hearing today (19.09.2018), the learned counsel appearing for the plaintiffs submitted that the matter has already been settled out of Court and therefore, the present suit may be dismissed. To that effect, he has also made an endorsement in the bundle.

2. Recording the above submissions and the endorsement made by the learned counsel appearing for the plaintiffs, this Civil Suit is dismissed as settled out of Court. There shall be no order as to costs. Consequently, connected application is also closed.
