THE HONOURABLE MR.JUSTICE N.SATHISH KUMAR V.Ravindran ...

Petitioner versus 1.The Inspector General of Registration, No.100. Santhome High Road, Chennai - 600 004.

2.The District Registrar, Thirupathur District, Thirupathur.

3.The Sub Registrar, Ambur Sub Registrar Office, Aambur, Thirupathur District.

Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 2nd respondent to consider the petitioner's representation dated 22.05.2023 and cancel the fraudulent documents in Document No.3858/2023 registered before Aambur Sub Registrar Office.

For Petitioner :

Mr.D.Rajagopal 1/4

For Respondent Nos.1 to 3 :

Mr.Yogesh Kannadasan Special Government Pleader

O R D E R

By consent of both sides, this Writ Petition is disposed of at the stage of admission itself.

2.

This Writ Petition is filed to direct the second respondent to cancel the registered Document No.3858/2023 by considering the petitioner's representation dated 22.05.2023. 3.

Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents 1 to 3 and perused the materials available on record.

4.

The grievance of the petitioner is that he made representation before the second respondent to cancel the Sale Deed registered by the fourth respondent in Document No.3858/2023. However, the same has not been considered. Hence, he seeks a direction. 5.

On perusal of the affidavit filed in support of this Writ Petition, it appears that the fourth respondent has executed certain documents without 2/4

considering the petitioner's case. Therefore, the petitioner seeks to cancel the documents. If the petitioner has any definite share in the property, the same can be obtained by way of filing a civil suit. 5.

In such view of the matter, no purpose would serve to give a direction to the Registrar to go into the transaction. Accordingly, this Writ Petition is dismissed. No costs.
