District Judge, Tindivanam (IN CMP.NO.14463/2021) pending disposal of the AS.NO.297/2021.
Order : This petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.V.RAJENDRAN, Advocate for the petitioner, the court made the following order:- The above application has been filed to grant an order of injunction restraining the defendant from alienating the property described in the schedule property which is the subject matter of the suit in O.S.No.29 of 2019 pending on the file of the learned II Additional District Judge, Tindivanam. The suit in question is one for partition and permanent injunction restraining the defendants from alienating the suit property to third parties and to declare the sale deed executed by the first respondent in favour of the second respondent dated 13.02.2013 as null and void and the plaintiff whose suit has been dismissed is in the appeal before this Court. https://hcservices.ecourts.gov.in/hcservices/
2.It is seen that though the plaintiff had sought for an interim injunction restraining the defendants from alienating the property, the plaintiff would not have the benefit of injunction pending the suit. Ultimately, the suit has been dismissed. Therefore, this Civil Miscellaneous Petition is dismissed.
