District Court at Tindivanam (IN CMP.NO.14460/2021) pending disposal of the AS.NO.297/2021. Order : This petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.V.RAJENDRAN, Advocate for the petitioner, the court made the following order:- The above application has been filed to stay the judgment and decree dated 05.02.2021 passed in O.S.No.29 of 2019 on the file of the II Additional District Court, Tindivanam, pending disposal of the appeal.

2.The plaintiff is the appellant before this Court challenging the dismissal of the suit. It is baffling as to how the plaintiff, whose suit has been dismissed, has come forward with this petition for staying the judgment and decree in O.S.No.29 of 2019 on the file of the II Additional District Court, Tindivanam, when the judgment and decree is only a dismissal of the suit. Accordingly, the Civil Miscellaneous Petition is dismissed.
