action and remove the illegal encroachments made by the respondents 6 to 8 in S.No.122/3 to an extent of 0.10.0 Hectares which has been classified as 'Odai' situated at Polayampalli Village, Harur Taluk, Dharmapuri District. For Petitioner:

ORDER

(Order of the Court was made by Dr.G.Jayachandran J.) The Tahsildar, Harur, has filed an affidavit clarifying the conflicting versions previously placed before this Court regarding the existence and removal of encroachments.

2.

Based on the affidavit and the accompanying photographs, it is seen that the encroachment has already been removed. Hence, We find that nothing survives in this writ petition filed as a Public Interest Litigation. 3.

However, we must add that the mere removal of encroachment is not sufficient. The Village Administrative Officer, Tahsildar and other authorities must ensure that no attempts are made to re-encroach upon the land. Hence, the 1st respondent, District Collector, is directed to issue memorandum to all subordinates instructing to prevent future encroachments. If any re-

encroachment occurs, strict departmental action shall be initiated against the responsible revenue authorities for dereliction of duty. 4.

With these observations, this Writ Petition stands disposed of. No costs.
