ORDER

The petitioner apprehends arrest for the alleged offence under Sections 7 (5), 20 (2) of Cigarette and other Tobacco Products Act r/w Section 123 of BNS, in Crime No.591 of 2024 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that, the petitioner was found in illegal possession of 559 kg of banned tobacco products. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and that he is ready to cooperate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.

4. Per contra, the learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and further submitted that the quantity of contraband involved in this case is 559 kg/- and it is a huge quantity. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to either side submissions. 6.Considering the nature of offence and the fact that the quantity of contraband involved (559kg) is substantial, this Court is of the view that, the petitioner does not deserve anticipatory bail. Hence, this Court is not inclined to enlarge the petitioner on anticipatory bail.

7. Accordingly, this Criminal Original Petition is dismissed. 18-03-2026 ep
