When this matter was taken up for hearing, it was represented by the learned counsel for the petitioners that the defacto complainant had amicably settled with the petitioners/accused. Therefore, this Court ordered notice to the defacto complainant. The learned counsel for the petitioners had taken private notice to the defacto complainant, but it had returned unserved.

2. Learned counsel for the petitioners submits that the defacto complainant after having agreed to settle the matter, is now going back. Under such circumstances, learned counsel for the petitioners seeks permission of this Court to withdraw this petition and he has also made an endorsement to that effect. Permission is granted.
