Respondent Petition is filed under Sections 433(e) and (f), 434(i)(a) and 439(i) and (b) of the Companies Act, 1956 prays (i) The respondent company Malabar Hotels Private Limited having its Registered Office at No.1/238, Old Mahabalipuram Road, Semmencheri, Chennai - 119 be would up by this Hon'ble Court under the provisions of the Companies Act, 1956, (ii) that the Official liquidator attached to this Hon'ble Court be appointed as the liquidator of the respondent company to take charge of its assets and affairs of the respondent company Malabar Hotels Pvt. Ltd. having its registered office at No.1/238, Old Mahabalipuram Road, Semmencheri, Chennai -119 and (iii) Direct the payment of the costs of this petition from and out of the assets of the respondent company upon liquidation.
