PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to pay interest of 10% to the petitioners for belated payment of Gratuity, Leave Salary, Provident Fund and Commutation of Pension amounts within a time frame. 1/4

The writ petition is filed for the relief set out below: "directing the respondents to pay interest of 10% to the petitioners for belated payment of Gratuity, Leave Salary, Provident Fund and Commutation of Pension amounts within a time frame."

2. It is the case of the petitioners that the petitioners 1 and 2 had worked as Special Grade Drivers in the respondent-Corporation and had retired from service on 29.02.2024 and 31.05.2024 respectively. The petitioner would submit that the respondents had settled all their retiral benefits including Service Gratuity, Provident Fund, Leave Salary and Commutation of Pension Amount etc., only on 25.08.2025 and 02.12.2025 respectively with a delay of 18 months and 19 months respectively. Therefore, the respondents are legally bound to pay the interest to the petitioners. The petitioners have submitted their representation on 03.03.2026 and 04.03.2026 to the respondents to pay the interest at the rate of 15% p.a., for the belated payment of the petitioners' 2/4

Earned Leave Salary, Gratuity Amount and Pension Commutation Amount. Since there is no response, the petitioners are before this Court.

3. Heard the learned Counsel on either side and perused the materials available on records.

4. Admittedly, the Earned Leave Salary, Gratuity Amount and Pension Commutation Amount has been paid belatedly paid to the petitioners for no fault of them. Hence, the petitioners are entitled to interest on the same. Therefore, a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Earned Leave Salary, Gratuity Amount and Pension Commutation Amount within a period of one (1) month from the date of receipt of a copy of this order.
