Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st respondent to dispose of the petitioner's appeal dated 13.03.2019 filed against the order of the 2nd respondent Na.Ka.24270/2017/A3 dated 02.01.2019 as early as possible. Mr.S.N.Parthasarathy, learned Government Advocate takes notice for the respondents 1 to 3. Since this writ petition is being disposed of, without affecting the interest of the respondents 4 & 5, notice to the said respondents is dispensed with.
2. This writ petition is filed seeking for a mandamus directing the 1st respondent to dispose of the petitioner's appeal filed against the order of the 2nd respondent arising out of UDR correction.
3. It is seen that the 2nd respondent passed an order on 02.01.2019 and the petitioner challenged the said order before the 1st respondent by filing an appeal on 13.03.2019. It is stated that the 1st respondent in pursuant to the filing of the appeal, has issued notice to the respective parties. Therefore, it is evident that the matter is pending before the 1st respondent.
4. Needless to say that when the appeal itself was filed on 13.03.2019, it is not fair on the part of the petitioner in approaching this Court and seeking for early disposal of the appeal filed by her. As it is seen that the appeal was filed as second round, initially after remanding the matter by the very 1st respondent himself in an earlier appeal filed, this Court is of the view that the 1st respondent shall dispose of the appeal at the earliest possible time, after hearing the petitioner, the respondents 4 & 5 and other interested parties, if any. With the above observation, this writ petition is disposed of, without expressing any view on the merits of the appeal filed by the petitioner. No costs.
