O R D E R
This Writ Petition has been filed seeking for a limited relief. The petitioner seeks for early disposal of the petitioner's application dated 24.10.2025 filed with the 1st respondent under the Maintenance and Welfare of Parents and Senior Citizen Act, 2007, seeking for cancellation of the settlement deeds dated 20.06.2017, registered as Document Nos.1134/2017, 1136/2017 and 1138/2017, on the file of the Sub Registrar, Thookanaicken Palayam Gobi (TK).
2.Mr.K.Surendran, learned Additional Government Pleader, accepts notice on behalf of the respondents 1 and 2. The 3rd respondent is the son of the petitioner, against whom the petitioner has filed the application under Senior Citizen Act, 2007.
3.No prejudice would be caused to the respondents if a direction is issued to the respondents 1 and 2 to dispose of the petitioner's application filed under
Section 23 of the Maintenance and Welfare of Parents and Senior Citizen Act, 2007, on merits and in accordance with law, after hearing the objections of the 3rd respondent and by adhering to the Principles of natural justice, within a time frame to be fixed by this Court. As seen, since no adverse orders are passed as against the 3rd respondent in this Writ Petition, notice to the 3rd respondent is dispensed with by this Court.
4.For the foregoing reasons, this Writ Petition is disposed of by directing the 1st respondent to pass final orders on merits and in accordance with law on the petitioner's application dated 24.10.2025 filed under Section 23 of the Senior Citizens Act, seeking for cancellation of the settlement deeds dated 20.06.2017, registered as Document Nos.1134/2017, 1136/2017 and 1138/2017, on the file of the Sub Registrar, Thookanaicken Palayam, Gobi (TK), after hearing the objections of the 3rd respondent and by conducting proper enquiry and by adhering to the Principles of natural justice, within a period of twelve weeks from the date of receipt of a copy of this order. However, there shall be no order as to costs.
