ORDER
The petitioner apprehends arrest for the alleged offence under Sections 318(4) of BNS, 2023, in Crime No.26 of 2026 on the file of the respondent police seeks anticipatory bail.
2. It is the case of the prosecution that the petitioner had mortgaged a car
belonging to the third party to the de facto complainant in order to lend money from him. Hence, the case.
3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. He further submits that he has not committed any offence as alleged by the prosecution. Hence, he prayed to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the investigation is still pending. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.
5. I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record.
6. From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the petitioner has mortgaged the car belonging to the third parties to the de facto complainant. Considering the gravity of the allegations, and taking into consideration the fact that the investigation is still pending and the consequences of granting anticipatory bail in such nature of the offence would affect the society at large. Hence, this Court is not inclined to
grant anticipatory bail to the petitioner.
7. In view of the above, this Court does not find any merit in the present anticipatory bail application. Accordingly, these criminal original petition is dismissed.
