O R D E R
(Order of the Court was made by M.Sathyanarayanan, J.) The petitioner, alleging non-compliance and willful disobedience of the order dated 19.06.2017 made in W.P.No.8896 of 2018, came forward with this petition for contempt.
2. When the matter is listed today, the respondent/contemnor has filed
an affidavit dated 28.02.2019 stating among other things that in terms of the directions, enumeration was done and 62 persons were enumerated from Thailavaram Scheme, out of which 40 persons only were eligible for allotment at Perumbakkam as per JNNURM condition and the eviction process was completed with the help of Revenue Department and Police officials. It is further stated that the representation dated 05.02.2018 submitted by the petitioner and 5 others in that regard was also rejected, vide, communication of the respondent in Na.Ka.No.Ko.6/95/Aa2/2018 dated 27.03.2018.
3. The learned counsel appearing for the petitioner would submit that liberty may be granted to the petitioner to challenge the said letter before the competent forum.
4. Mr.S.Prabhu, learned Standing Counsel appearing for the respondent/contemnor would submit that the above said communication dated 27.03.2018 was also despatched to the petitioner and it was returned with an endorsement "Left".
5. In the considered opinion of the Court, the order, which is the
subject matter of this Contempt Petition, has been complied with and necessary communication has also been sent to the petitioner on 27.03.2018.
6. In the light of the said development, nothing survives for further adjudication and accordingly, this Contempt Petition is closed. If the petitioner is so advised and if it is open to him under law, he is always at liberty to challenge the above said letter dated 27.03.2018 before the competent forum.
