PRAYER: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to direct the first respondent and second respondent to execute the arrest warrant dated 16.03.2021 passed in M.P.NO.55 of 2021 in MP.NO.770 of 2019 in MP.NO.308 of 2018 in MC.292 of 2014 by the V Additional Family Court Judge, Chennai against the third respondent. ORDER

This Criminal Original Petition has been filed to direct the first respondent and second respondent to execute the arrest warrant dated 16.03.2021 passed in M.P.NO.55 of 2021 in MP.NO.770 of 2019 in MP.NO.308 of 2018 in MC.292 of 2014 by the V Additional Family Court Judge, Chennai against the third respondent.

2. It is seen from the submission of the learned counsel for the petitioners and the fact that the arrest warrant was issued for non payment of arrears of maintenance by the third respondent. Despite issuance of letter from the learned V Additional Family Court Judge, Chennai to the second respondent, till now, the arrest warrant is not executed.

3. Therefore, this Court directs the first and second respondents to execute the arrest warrant against the third respondent, as expeditiously as

possible, preferably within a period of four weeks from the date of receipt of a copy of this order. Thereafter, produce the third respondent before the learned V Additional Family Court Judge, Chennai for taking further necessary action.
