Respondent Prayer:- Criminal Original Petition filed under Section 482 Cr.P.C., to direct the respondent herein namely, the State of Tamil Nadu, rep by the Inspector General of Police, Economic Offences Wing-II, SIDCO, Old Corporate Building, First Floor, Garment Complex-II, Thiru-Vi-ka, Industrial Estate, Guindy, Chennai 600 032, to register First Information Report against HBN Dairies & Allied Ltd., (a public limited company) and its officials, on the basis of the complaint letters dated 04.04.2016 and 11.05.2016, sent by the petitioner by post for offences punishable under law and take up the same for investigation.

This petition has been filed to direct the respondent herein namely, the State of Tamil Nadu, represented by the Inspector General of Police, Economic Offences Wing-II, SIDCO, Old Corporate Building, 1st Floor, Garment ComplexII, Thiru-Vi-ka, Industrial Estate, Guindy, Chennai 600 032, to register First Information Report against HBN Dairies & Allied Ltd., (a public limited company) and its officials, on the basis of the complaint letters dated 04.04.2016 and 11.05.2016, sent by the petitioner by post for offences punishable under law and take up the same for investigation. https://hcservices.ecourts.gov.in/hcservices/

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.

3. When the matter was taken up for hearing, learned Additional Public Prosecutor submitted that on the complaint given by one Jayabharathi, the respondent police have registered a case in Cr.No.3 of 2016 for offences u/s 406, 420, 120b IPC r/w Section 5 of TNPID Act against the financial establishments and persons who are in-charge of the same. Learned Additional Public Prosecutor also submitted that the petitioner has been enlisted as a witness as there cannot be a second FIR for the same transaction/prosecution. Recording the same, this petition is closed.
