Defendants PRAYER: Plaint under Order IV Rule 1 of O.S.Rules read with Order VII Rule 1 of the C.P.C.

(a) for declaring the title of the Plaintiffs to the suit schedule property and directing the 10th Defendant to deliver vacant possession of the suit schedule property to the Plaintiffs.

(b) to grant permanent injunction restraining the Defendants or any of them or their men, agent/s or any one acting on their behalf from in any way alienating or encumbering the suit schedule property;

(c ) to pay Rs.7,20,000/- towards past mesne profits and such sum as this Court may determine from date of suit till date of delivery of possession.

(d) to pay costs of the suit.

JUDGMENT

Today, when the matter is taken up for hearing, the learned counsel for the Plaintiffs has filed a Memo stating that the suit may be dismissed as not pressed as against the Defendants 1 to 9, 11 and 13 and the matter has been settled between the plaintiffs and the defendants 10 and 12.

2. Recording the said Memo, the suit is dismissed as not pressed as against the defendants D1 to D9, D11 and D13 and as against the other defendants the suit is
