This Criminal Miscellaneous Petition has been filed to extend the time to recall the Non Bailable Warrant Petition in Crl.O.P.No.5249 of 2021 order dated 16.03.2021.
2.This Court, by order, dated 16.03.2021 in Crl.O.P.No.5249 of 2021, on the undertaking given by the petitioners, directed them to appear before the learned Principal Sessions Judge, Salem, within a period of two weeks from 16.03.2021 and to file a petition to recall the NBW issued against them.
3.The learned counsel for the petitioners submitted that the petitioners unable to execute the sureties for the reason that the petitioners received the order copy on 26.04.2021. The learned Principal Sessions Judge, Salem not accepted the recall petition for the reason that the date of the order is 16.03.2021 and it was expired on 30.03.2021. Hence, the learned counsel for the petitioners seeks further period of two weeks time Page No.1/3
to file a recall petition before the trial Court. 4.Being satisfied with the submissions made by the learned counsel for the petitioner, this Court is inclined to grant another two weeks time. The petitioners are directed to appear before the learned Principal Sessions Judge, Salem within a period of two weeks from the date of lifting of lock down and normal functioning of Court below. The learned Principal Sessions Judge, Salem is directed to consider the same on merits and pass orders on the same day.
