ORDER
This writ petition has been filed seeking for a direction to the third respondent to cancel the patta issued in the name of Mr. Dakshinamoorthy for the property, morefully described in the prayer to this writ petition, within a time frame to be fixed by this Court.
2. According to the petitioner, the patta has been issued in the name of a dead person, as Mr. Dakshinamoorthy died as early as on 29.01.1996 itself. The petitioner claims that he is in possession of the property for a number of years and without any notice to him, patta was issued in the name of Mr. Dakshinamoorthy. The petitioner had given a representation on 30.09.2024 to the third respondent seeking for cancellation of patta standing in the name of Mr. Dakshinamoorthy. Since the same has not been considered, the petitioner
has filed this writ petition.
3.Mr. C. Jayaprakash, learned Government Advocate accepts notice on behalf of the respondents 1 to 5. Since no adverse order is passed against the respondents 6 and 7, notice to the respondents 6 and 7 is dispensed with. 4.No prejudice would be caused to the official respondents if the petitioner's representation as stated supra is considered, on merits and in accordance with law, after hearing the objections of the respondents 6 and 7 and any other third party whom the third respondent deems it fit to enquire within a time frame to be fixed by this Court.
5.This Court is not expressing any opinion on the merits of the petitioner's representation.
6.For the foregoing reasons, this writ petition is disposed of by directing the third respondent to pass final orders, on merits and in accordance with law on the petitioner's representation dated 30.09.2024 seeking for cancellation of patta standing in the name of Mr. Dakshinamoorthy for the property, morefully described in the prayer to this writ petition, after hearing the objections of the respondents 6 and 7 and also any other third party whom the third respondent deems it fit to enquire within a period of 12 weeks from the date of receipt of a
copy of this order. No costs.
