O R D E R

This revision arises against the judgment dated 25.07.2012 passed by learned I Additional District and Sessions Judge, Coimbatore, in C.A.No.75 of 2012 confirming the conviction passed by the learned Judicial Magistrate No.I, Coimbatore, in S.T.C.No.1514 of 2007 dated 13.02.2012.

2. This Court vide order dated 28.08.2012 granted interim stay on condition that the petitioner should deposit 50% of the cheque amount. The petitioner has duly complied with all the conditions as directed by this Court and deposited 50% of cheque amount before the learned Judicial Magistrate No.I, Coimbatore, in S.T.C.No.1514 of 2007.

3. When the matter is taken up today, both the parties filed the joint memo of compromise and both parties also appeared before this Court and the defacto-complainant has received the cheque amount.

4. Heard, the learned counsel appearing for the petitioner and the learned counsel appearing for the respondent.

5. In view of the settlement arrived at between the parties, the Criminal Revision Case shall stand allowed. Accordingly, the offence under section 138 of the Negotiable Instrument Act shall stand compounded. Petitioner shall stand acquitted in the case. Fine amount, if any, paid by the petitioner shall be refunded to him.
