Earlier on 15.02.2017, this Court had dismissed this Tr.C.M.P.No.140 of 2017 for non prosecution. Subsequently, the said dismissal of Tr.C.M.P. for non prosecution had been set aside and the Tr.C.M.P.No.140 of 2017 was restored to file on 13.06.2017 and this Court directed the Registry to list the Tr.C.M.P.No.140 of 2017 'for admission' on 15.06.2017. Subsequently, on 16.06.2017, this Court ordered notice to the respondent returnable in two weeks and private notice was also permitted. Consequently, when the Tr.C.M.P.No.140 of 2017 was taken up for hearing on 13.10.2017, there was no representation for the petitioner, and hence this Court directed the Tr.C.M.P. to be listed under the caption 'for dismissal' on 20.10.2017.

Today (i.e. on 20.10.2017), when the Tr.C.M.P.No.140 of 2017 is taken up for hearing, there is no representation for the petitioner, either in person or through counsel, inspite of the matter being listed in the said caption.
