ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 8(c), 20(b)(ii)(c), 25 and 29(1) of Narcotic Drugs & Psychotropic Substances Act 1985 in Crime No.158 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 25.04.2021, the petitioner along with other accused persons were illegally found in possession of 2 Kgs. of Kanja. Thereby, the respondent police registered a case against the petitioner and other accused persons.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence and the petitioner has been falsely implicated in this case. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate submitted that the petitioner along with other accused persons were found in possession of 2 kgs. of Kanja and the petitioner has four previous cases pending against him. Hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case and also of the fact that the petitioner is a habitual offender and there are four previous cases pending against him, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. -sd/- 14/06/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
