Defendants Prayer : This Civil Suit has been filed under Order IV Rule 1 of O.S.Rules r/w Sec.55-62 of the Copyright Act and Order VII Rule 1 of C.P.C praying for judgment and decree as follows:- a) for a declaration that the plaintiff is the sole exclusive and absolute owner of the perpetual Overseas rights including all T.V. and Radio Rights, V.C.D., D.D., HDDVD, etc., Cable T.V.Rights, etc. of the Tamil Talkie picture titled KUTTYRA PIRIVU (Tamil, Colour 35 MM);

b) for a permanent injunction restraining the defendants, their men, agents or servants or anybody claiming through or under them from infringing the limited copyright in respect of the suit picture viz. The perpetual Overseas rights including all T.V and Radio Rights, V.C.D., D.D., HDDVD, etc., Cable T.V.Rights, etc., of the Tamil Talkie picture titled KUTTYRA PIRIVU (Tamil, Colour, 35 MM) in any manner whatsoever;

c) to award cost of the suit and d) granting such other relief and reliefs.

JUDGMENT

Learned counsel for the plaintiff has made an endorsement in the plaint that it has been settled out of Court and hence, prays for withdrawal of the suit.

2. In the light of the above said endorsement, the Civil Suit is dismissed as withdrawn. Consequently connected original application is closed. No costs.
