Respondents Prayer: Petition filed under Section 11(4) of the Arbitration & Conciliation Act, 1996 to appoint an independent arbitrator as per clause 12 of the Contract agreement dated 10.2.2010 entered into between the petitioner and the respondent to resolve the dispute that arose between the parties with regard to the payment of the balance amount of Rs.6,29,431/-with interest.

O R D E R

Both the parties, after negotiation, has arrived at a settlement and reduced down the terms into writing a Joint Memo of settlement dated 19.12.2018 signed by petitioner and its counsel and 1st respondent and counsel for the respondent.

2. Pursuant to the joint memo of settlement, the 1st respondent has settled the balance dues to the petitioner by way of a Demand Draft dated 6.12.2018 for a sum of Rs.1,24,855/- drawn on Union Bank of India in favour of the petitioner and the receipt of which is duly acknowledged by the petitioner.

3. The Joint Memo of Settlement dated 19.12.2018 is taken on record which shall form part and parcel of the order.

4. Accordingly, the Original Petition is disposed of in terms of Joint Memo of Settlement dated 14.12.2018 which shall form part and parcel of this order. No costs.
