Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus or any other writ, order or direction in the nature of a writ, directing the 2nd respondent herein to dispose the appeal, dated 05.05.2017 filed by the petitioner against the impugned order dated 31.03.2017 within stipulated time.

O R D E R

The relief sought for in this writ petition is for a direction to direct the 2nd respondent to dispose the appeal dated 05.05.2017, filed by the petitioner against the order of punishment dated 31.03.2017.

2. The learned counsel appearing for the writ petitioner made a submission that the writ petitioner was appointed as Helper in the year 1987 and thereafter, promoted to the posts of Wireman and further promotion was granted to the post of Assistant Engineer. On account of certain allegations, Disciplinary Proceedings were initiated against him and after enquiry, an order of punishment dated 31.03.2017 was issued, imposing punishment of stoppage of increment for two years with https://hcservices.ecourts.gov.in/hcservices/

cumulative effect. Against the order of punishment, the writ petitioner preferred an appeal to the 2nd respondent on 05.05.2017 and the same is yet to be considered.

3. In this view of the matter, without going into the merits of the case, the 2nd respondent is directed to consider the appeal preferred by the writ petitioner on 05.05.2017 and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. Accordingly, the writ petition stands disposed of. However, there shall be no order as to cost.
