IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED : 28.04.2022 CORAM: JUSTICE N.SESHASAYEE T.Senthilkumar ... Petitioner Vs.

P.Pandian ... Respondent PRAYER: The Civil Revision Petition filed under Article 227 of the Constitution of India, to direct the learned Additional District Judge, Krishnagiri to number the petition in unnumbered interlocutory application in I.A. No.____ in O.S. No.40 of 2020.

For Petitioner :

Mr.V.Sakkarapani

O R D E R

In a suit filed in the year 2020, the defendant has taken out an application under Order VII Rule 11 CPC, which has not been taken on record. On perusal of the papers filed before the court, this court finds that the said application is only transacted between the revision petitioner and the registry of the concerned court, almost infinitely.

2. The learned Additional District Judge, Krishnagiri is now required to attend to the same personally and take the application on to the record of the court, if the same is otherwise in order. The learned Judge is also informed the procedure is merely a handmaid of justice and a maid must be treated as a maid and no more.

3. With the above direction, the civil revision petition stands disposed of. However, there is no order as to costs.
