Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of mandamus directing the 1st respondent to re-issue the petitioner passport bearing Number H8529069 within a reasonable time.

ORDER

The writ petition is filed for the issuance of a writ of mandamus directing the 1st respondent to re-issue the petitioner passport bearing Number H8529069.

2. It appears that the petitioner's request for re-issuance of the passport when the earlier one having been lost was not considered on the ground that non traceable certificate has not been obtained.

3. The learned counsel for the petitioner submitted that after the filing of the writ petition, a non traceable certificate is in fact been issued by respondent No.2.

4. The learned counsel for the first respondent submitted that in such an event, the petitioner's request may be considered on merits.

5. In such a view of the matter, writ petition is disposed of directing the petitioner to submit the non traceable certificate to respondent No.1 within two weeks from the date of receipt of a copy of this order and on receipt of the same, the first respondent shall take appropriate expeditious action towards re-issuance of passport as per law. No costs.
