This writ petition has been filed to issue a Writ of Mandamus for a direction to dispose of the appeal in A/3663/2015 dated 18.09.2015 preferred against the proceedings dated 04.08.2015 issued by the 2nd respondent.

2. It is informed by the learned counsel for the petitioner that pending the writ petition, the petitioner has passed away. However, he seeks short accommodation to implead the legal heirs of the petitioner.

3. This Court is of the view that once the petitioner has died, the proceedings will become abated. However, it is submitted that the appeal is still pending. In such an event, it is left open to implead the legal heirs of the petitioner in the said appeal and the first respondent is directed to dispose of the appeal within a period of two months from the date of impleading the legal heirs of the petitioner.

4. Accordingly, this writ petition stands disposed of. No costs.
