[ RESPONDENTS ] Writ petition is filed under Article 226 of the Constitution of India praying for a writ of mandamus to direct the respondents to consider the representation of the petitioner dated 28.05.2015 to reinstate the petitioner to the post of Salesman in K.K.115 Pellarampalli Agricultural Co-Op. Society.

O R D E R

With the consent of the learned counsel appearing on either side, the Writ Petition is taken up for final disposal at the admission stage itself.

2.The petitioner was placed under suspension. Thereafter, the Deputy Registrar of Co-operative Society, conducted an enquiry on the charge memo and he gave a report that the charges were not proved. In these circumstances, the respondent Society by a resolution dated 11.5.2015, revoked the suspension order and sent the copy of the resolution to the Deputy Registrar for his approval. Once the Deputy Registrar approves the resolution, the petitioner would be restored to duty.

3.The learned counsel appearing for the respondents submits that the third respondent would pass an order on the resolution of the society within a period of one week.

4.In my considered view, the third respondent has no option, but, to accept the resolution of the Society, particularly, when the enquiry officer held that the charges were not proved and the same was accepted by the Society.

5.In these circumstances, the aforesaid statement of the third respondent that he would pass an order on the resolution of the society within a period of one week, is recorded and the Writ Petition is disposed of accordingly. No costs.
