..Respondent(s) Writ petition is filed under Article 226 of the Constitution of India seeking for issuance of a writ of mandamus to direct the respondent to entertain, register and release the document, being a sale deed presented by the petitioner for registration in respect of the property, being a vacant site, comprised in Survey No.200/14C3, measuring to an extent of 2180 Sq.feet, situated at No.468, T.H.Road, Edapalayam, Minjur- 601 203, Ponneri Taluk, Tiruvallur District.

ORDER

This writ petition has been filed to direct the respondent to register and release the sale deed to be presented by the petitioner for registration, in respect of the property morefully disclosed in the prayer to this writ petition.

2. According to the petitioner, she attempted to present the sale deed for registration with the respondent. But, despite the same, the respondent refused to receive the document for registration by giving frivolous reasons. According to the petitioner, the very same property, which is the subject matter of the sale deed to be presented by the petitioner for registration, was earlier allowed to be registered by the very same registration department. The petitioner also claims that the property in question is an approved plot, and therefore, there is no legal impediment for the respondent to register the sale deed to be presented by the petitioner for registration.

Mr.P.Harish, learned Government Advocate, accepts notice on behalf of the respondent, and on instructions, he submits that once the petitioner presents the sale deed for registration with the respondent, the respondent shall take a final decision as to whether the sale deed to be presented by the petitioner can be registered or not.

In view of the above, this writ petition is disposed of by directing the petitioner to present the sale deed for registration with the respondent within a period of one week from the date of receipt of a copy of this order. On presentation of the said sale deed, the respondent shall receive the same and shall take a final decision as to whether the said sale deed can be registered or not, on merits and in accordance with law, within a period of one week

thereafter. In case the respondent decides to refuse registration of the said sale deed, the respondent shall pass a speaking order after giving due consideration to the contentions of the petitioner as raised in this writ petition.
