The applicants/plaintiffs shall pay a sum of Rs.5,000/- as cost to the learned counsel appearing for the respondent, on or before 29.10.2020.

2. Post the matter for reporting compliance on 02.11.2020.

3. It is made clear that considering the various proceedings that has taken place between the parties there appears to be serious allegations against the defendants including forging of documents. In these circumstances the application for for condoning the delay in filing the application to restore the suit is ordered. Considering the nature of the averments contained in the affidavit and written submission of the applicant, the restoration application is also ordered and the Registry is directed to number the same.

4. The defendants shall ensure that the written statement is filed on or before 23.11.2020 and the Registry shall also number the application filed for impleading the subsequent purchasers.

5. Consequently, A.No.9661 of 2019 is allowed and the application for restoring the suit to file is also ordered and the Registry is directed to number the same.
