Karanoor Evangelical Church of India (ECI) situate at Survey No.386/14, Akkarai Chengampalli Village, MGR Nagar, Annur Taluk, Coimbatore District pending disposal of the petitioner's application dated 31.05.2017 for assignment of the subject land on payment of value to be fixed by the 1st Respondent based on the consequential proceedings, dated 04.10.2017 issued by the office of the 1st respondent and the proceedings under the Tamil Nadu Land Encroachment Act, 1905.

Today, Learned Counsel for the Petitioner has made an endorsement in the Writ Petition to the following effect: "Since the 2nd Respondent has passed an order in Na.Ka.No.4411/2013/A1 denying permission for the Petitioner Church, the Petitioner may be permitted to withdraw the Writ Petition with liberty to challenge the impugned order."

Recording the aforesaid fact, this Writ Petition is dismissed as withdrawn. No costs. Consequently, connected W.M.P.No.37893 of 2017 is closed.
