Petition filed under Article 226 of the Constitution of India for the issuance of writ of mandamus directing the respondents to grant the petitioner promotion as Chief Civil Surgeon under Person Oriented Promotion Scheme with the Pay Band of Rs.34,700 - 67,000/- and Grade Pay of Rs.8,700/- with effect from the Date of Completion of 20 years of service that is from 23.10.2009 as provided in G.O.Ms. No.354 dated 23.10.2009 read with G.O.Ms.No.201 dated 06.9.2013 both issued by the 1st respondent and sanction and pay the petitioner the revised terminal benefits, based on which promotion and the pay to be paid to the petitioner as on the date of Retirement together with interest Awards costs.

The petitioner worked as Civil Surgeon and on attaining the age of superannuation retired on 30.4.2014.

2. It is the grievance of the petitioner that he was not given due promotion as Chief Civil Surgeon under Person Oriented Promotion Scheme and more particularly, in accordance with the Government Orders in G.O.Ms.No.201 dated 06.9.2013 and G.O.Ms.No.354 dated 23.10.2009 respectively. The petitioner has already given a representation on 04.9.2014. However, there was no follow up action taken by the respondents resulting in filing this writ petition. https://hcservices.ecourts.gov.in/hcservices/

3. The first respondent is directed to consider the representation submitted by the petitioner on merits and as per law and more particularly, in the light of the Government Orders referred

to above and the order dated 17.10.2014 in WP.No.27696 of 2010. Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order.
