ORDER

The petitioner apprehends arrest for the alleged offence under Sections 406 and 420 of the Indian Penal Code in Crime No.16 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that under the guise of running a trading company, the petitioner has cheated the de facto complainant and four other victims to the tune of Rs.50,00,000/-. Hence, this case.

3. The learned counsel for the petitioner submitted that the petitioner was innocent and that he has been falsely implicated in this case. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and he is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. At this juncture the learned counsel for the Intervenor submitted that all the accused had absconded and that entire company has been dismantled.

5. At this juncture, the learned Government Advocate (Crl.Side) submitted that unless the petitioner has been taken on custody, the involvement of layering of the money cannot be identified. The petitioner has cheated Rs.50,00,000/- and also submitted that the petitioner has been arrested in similar offenses in Crime No.33 of 2026 dated 10.02.2026.Hence, he opposed to grant anticipatory bail to the petitioner.

6. I have given my anxious consideration to the submissions made by the

learned counsel on either side and perused the materials available on record.

Considering the facts and circumstances of the case and considering the totality of the circumstances and upon the submission of the learned Government Advocate(Crl.Side), this Court is of the firm view that custodial interrogation of the petitioner is required to identify the layering of the money. Hence, for the present it is not appropriate to consider the bail application of the petitioner. Hence, this Court is not inclined to enlarge the petitioner on anticipatory bail.

8. Accordingly, this Criminal Original Petition is dismissed and the connected miscellaneous petition is closed.
