Prayer: Writ Petition filed under Article 226 of the Constitution of India for 1/5

issuance of a Writ of Mandamus, directing the 2nd respondent to cancel the patta No.6953 dated 22.08.2023 in respect of the land comprised in Survey Nos.208/47 to an extent of 1.36.00 hectare (89 cents) situated at Jogiripalayam, A-Chettypalli Revenue Village, Shoolagiri Taluk, Krishnagiri District based on the petitioner's representation dated 11.10.2023 and to issue fresh patta in respect of legal heirs of Muniyappan, son of Venkataramaiya, forthwith.

O R D E R

The petitioner herein seeks a direction to the second respondent to cancel the patta No.6953 dated 22.08.2023 issued in favour of Chinnaraj, predecessor in respect of the respondents 4 to 8.

According to the petitioner, the property situated in S.Nos.208/47 at Jogiripalayam, A-Chettypalli Revenue Village, Shoolagiri Taluk, Krishnagiri District, with an extent of 1.36.00 hectare (89 cents) , originally belonged to father of the petitioner and patta was also issued in respect of legal heirs of Muniyappan, son of Venkataramaiya. Later, the patta 2/5

was wrongly transferred in the name of Chinnaraj, son of Muniyappa, who happen to be the predecessor in interest of the respondents 4 to 8. After acquiring knowledge about the wrong entry in the revenue records, the petitioner submitted a representation to the respondents on 11.10.2023 seeking cancellation of the patta issued in the name of Chinnaraj, namely the predecessor of respondents 4 to 8 and to issue patta in the name of the petitioner. The said representation has not been considered till date.

3. Mr.U.Baranidharan, learned Additional Government Pleader, who takes notice for the respondents 1 to 3 would submit that the representation of the petitioner will be considered in accordance with law, after issuing necessary notice to the interested parties.

In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the second respondent to consider the representation of the petitioner dated 11.10.2023 and pass final order on its own merits, after issuing notice to the respondents 4 to 8 within a period of 8 weeks from the date of receipt of copy of this order. 3/5

5. With the above direction, this Writ Petition is disposed of. No costs.
