ORDER
By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself. Since no adverse order is passed against the private
respondent, notice to the private respondent is dispensed with.
2. This petition has been filed for a direction, directing the 1st Respondent to dispose of the statutory appeal preferred by the petitioner in Appeal No. 12554367/G/2025 filed on 12.12.2025, within the time frame fixed by this Court and consequently grant an order of stay of all further proceedings pursuant to the award dated 07.03.2012 in A.C.D. No.419/2011 pending disposal of the above appeal.
3. It is the case of the petitioner that the third respondent filed a claim petition before the second respondent alleging the petitioner was a subscriber to a chit and defaulted in payment of Rs.2,27,432/- based on which an ex parte award was passed against the petitioner on 07.03.2012. Thereafter, EP.No.75 of 2021 was filed by the third respondent, challenging the award, the petitioner filed appeal before the first respondent on 12.12.2025 which is pending without consideration, till date. Hence, this writ petition.
4. Heard both sides and perused the materials placed on record. Considering the facts and circumstances of the case, this Court without going into the merits of the case directs the first respondent to dispose of the appeal dated 12.12.2025 filed by the petitioner and pass appropriate orders on merits and in accordance with law within period of twelve weeks from the date of
receipt of a copy of this Order.
5. Accordingly, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition stands closed. 26-03-2026 dhk Index:Yes/No Speaking/Non-speaking order Internet:Yes
