ORDER

The present writ petition has been filed praying for a writ of mandamus to direct the 3 rd respondent to conduct an inquiry based on the representation dated 07.01.2021 submitted by the petitioner, forwarded by the 2 nd respondent in proceedings dated 05.02.2021.

It is submitted by the learned counsel for the petitioner that petitioner had requested to issue patta in respect of the land comprised in S.F.No.106/B, Perur Villagae, Coimbatore District, which according to the petitioner was purchased by his great-grandfather P.T. Narayana Iyer in a Court auction. However, the said land has been wrongly classified as 'Sarkar Poramboke'. The petitioner had taken out a representation for inquiry into the nature/classification

of the land and for issuance of patta. Since no action has been taken, the present writ petition has been filed.

The learned Additional Government Pleader appearing on behalf of the respondents would submit that pursuant to the representation submitted by the petitioner, a communication was also issued by the 2 nd respondent to the 3 rd respondent, directing the 3 rd respondent to conduct an inquiry and forward a report. Learned Additional Government Pleader would submit that petitioner's representation will be considered and appropriate orders would be passed within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.

In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, rd respondent to conduct an inquiry based on the there shall be a direction to the 3 petitioner's representation dated 07.01.2021, on its own merits and pass appropriate orders in accordance with law, after affording reasonable

opportunity of hearing to the petitioner and any other interested persons/stake holders, including rival claimants, if any, within a period of 8 weeks from the date of uploading of the web copy without waiting for the receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law.
