1.Mrs.N.Sakunthala 2.Mrs.V.Annapoorani ... Defendant This case came up for settlement before the Lok Adalat. Mr.S.Sathish Rajan, learned counsel for the plaintiff and Mr.S.P.Patel, the learned counsel for the defendant defendant are present.
TERMS OF SETTLEMENT The suit has been referred to the Lok Adalat under Order VII Rule 1 of the code of Civil Procedure for effecting a compromise between the plaintiff and the defendant. Both sides are present today.
2. The plaintiff filed a suit for recovery of a sum of Rs.40,25,000/- with interest from the date of the suit.
3. The plaintiff and the defendant entered into a compromise, fixing the amount due as Rs.40,00,000/- Accordingly, the defendant paid a sum of Rs.40,00,000/- to the plaintiff and the letter received the same. It was also agreed by both the parties that the original sale deed filed as Doc.No.1 shall be returned to the power of attorney agent viz., Mr.K.Sukumaran. After passing of the award, the Registry shall return the Doc.No.1 to Mr.K.Sukumaran.
4. In view of the above compromise, the Civil Suit stands disposed of as settled. The memo of compromise filed by the parties shall form part of the decree.
5. The full Court fee shall be refunded to the plaintiff in the manner provided under Section 69-A of the Tamil Nadu CourtFees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act
1987 as amended in 1994 and there shall be no demand for additional Court fee.
