PRAYER - This Writ Petition is filed under Article 226 of the Constitution of India, seeking a Writ of Mandamus, directing the 3rd respondent to pass orders on the representation dated 17.09.2025 by rectifying the FMB Sketch for the S.Nos.155/3 and 155/4 at Aragalur Village, Thalaivasal Taluk, Salem District and issue patta in favour of the petitioner for the S.No.155/4. O R D E R
This Writ Petition has been filed to direct the 3rd respondent to rectify the FMB Sketch in respect of the properties morefully disclosed in the prayer to this Writ Petition and thereafter, issue patta in favour of the petitioner for Survey No.155/4 based on the petitioner's representation dated 17.09.2025, within a time frame to be fixed by this Court.
2.As seen from the documents filed along with this Writ Petition, the petitioner's representation referred to supra has already been acted upon by the 3rd respondent and he has also conducted an enquiry. Since the 3rd respondent has already acted upon the representation of the petitioner dated 17.09.2025 and he has already commenced enquiry, this Court is of the considered view that no
prejudice would be caused to the 3rd respondent if a direction is issued to the 3rd respondent to dispose of the petitioner's representation within a short time, after hearing all the necessary parties. Since no adverse orders are passed as against the respondents 6 & 7, notice to the respondents 6 & 7 in this Writ Petition is dispensed with by this Court.
3.Accordingly, this Writ Petition is disposed of by directing the 3rd respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 17.09.2025, seeking for rectification of the FMB Sketch for the properties morefully disclosed in the prayer to this Writ Petition and thereafter, issue patta in favour of the petitioner for Survey No.155/2004, after giving due consideration to the supporting documents produced by the petitioner and after hearing the objections of all the necessary parties, which includes the respondents 6 and 7, within a period of six weeks from the date of receipt of a copy of this order.
