Respondents PRAYER:

Writ petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, forbearing the respondents from laying any road in between the petitioner's property in Survey No.187/6, Sembodai Village, Nagapttinam District.

O R D E R

The learned Special Government Pleader, appearing on behalf of the respondents, states that the third respondent has filed a counter stating that there is no proposal to lay any roads in the property belongs to the writ petitioner and in this regard, the statement made in https://hcservices.ecourts.gov.in/hcservices/

paragraphs 7 and 8 of the counter-affidavit, which is extracted hereunder:- "7. It is pertinent to note that the respondent has not initiated any steps to any road in the said Survey No.187/6 as mentioned by the petitioner with mala fide intention.

8. I further submit that there is no proposal to lay road in the private property as stated by the petitioner.

But regarding the common passage laying of pipeline is concerned the same is already said in the Cart Tract in S.No.84/2H and the suit is already pending before the Trial Court."

2. In view of the abovesaid statement made by the learned Special Government Pleader for the respondents, no further adjudication is required in this writ petition.
