Criminal Original Petition filed under section 482 of Criminal Procedure Code, praying to transfer the investigation of the above said case in Crime No.774 of 2019 on the file of the 2nd respondent herein. The Inspector of Police, Peerkankaranai Police Station, Chennai, to the file of the Deputy Superintendent of Police, CBCID, Chennai or any other competent investigating agency for proper investigation and report before competent Court.

O R D E R

This petition has been filed seeking to transfer the investigation of the case in Crime No.774 of 2019, pending on the file of the 2nd respondent herein viz., The Inspector of Police, Peerkankaranai Police Station, Chennai, to the file of the Deputy Superintendent of Police, CBCID, Chennai. https://hcservices.ecourts.gov.in/hcservices/

2. The learned Additional Public Prosecutor would submit that the accused is actually residing at Malaysia and now only he has proceeded to India and he was arrested in another crime relating to Thazhambur police station and proceeding with the investigation.

3. The learned counsel appearing for the petitioner submitted that though the petitioner was arrested pursuant to another Crime relating to Thazhambur police station, even then the second respondent did not taken any steps to secure the accused person even though the amount involved is more than Rs.3,00,000/-(Rupees Three Lakhs).

4. Considering the above submission, the second respondent police is directed to take steps to secure the accused in Crime No.774 of 2019 and complete the investigation and file a final report within 12 weeks from the date of receipt of a copy of this order. The Assistant Commissioner, Vepperi, Chennai, is directed to monitor the investigation done by the second respondent and ensure that the second respondent shall comply with the order of this Court.

5. Accordingly, this Criminal Original Petition stands disposed of.
