ORDER

The petitioner, who was arrested and remanded to judicial custody on 31.01.2026 for the alleged offences under Section 310(4) of B.N.S. in Cr. No.46 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 31.01.2026, when the respondent police were on routine patrol duty, found the accused in unlawful assembly with iron rod and they were preparing for dacoity and hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is under incarceration since 31.01.2026 and he is ready and willing to abide by any condition that may be imposed by this Court and hence prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police reiterated the prosecution case and strongly opposed to enlarge the petitioner on bail on the ground that the petitioner has also involved in 12 other previous cases.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. The learned Government Advocate strongly opposed the bail application stating that the petitioner has 12 previous cases and this case is also a case of attempting to dacoity. Therefore, considering the nature of allegations against this petitioner and its severity and upon the fact that the petitioner has

been involved in so many cases, this Court is of the firm view that the petitioner is not entitled to any bail at this stage.

7. Accordingly, this Criminal Original Petition is dismissed. 25-03-2026 MJS Note:
