By consent given by both sides, this writ petition is taken up for final hearing at the admission stage itself. 2.This writ petition has been filed for issuance of writ of mandamus directing the second respondent to consider the petitioner's representation dated 11.06.2018 and pass orders within the time stipulated by this Court.
3.The case of the petitioner is that the property originally belong to the petitioner's grandfather. After his demise, it vested with his father. The further case of the petitioner is that his father and mother died leaving behind the petitioner and seven other legal heirs. According to the petitioner, one of the legal heir by practising deceit managed to obtain the patta in his favour. Aggrieved by the same, the petitioner has made a representation to the second respondent on 11.06.2018 to cancel the patta. Since the same was not acted upon, the present writ petition has been filed before this Court seeking for appropriate directions.
4.Heard Mr.J.Arulprakasam, learned counsel appearing on behalf of the petitioner and Mr.Aruldas, learned Government Advocate, appearing on behalf of the respondents 1 to 4. 5.Taking into consideration the facts and circumstances of the case and the limited relief that has been sought for in this petition, there shall be a direction to the second respondent to consider the representation of the petitioner dated 11.06.2018 and conduct an enquiry after issuing notice to respondents 5 to
7. The proceedings shall be completed and orders shall be passed within a period of 12 weeks from the date of receipt of copy of this order.
6.The petitioner is directed to make a fresh representation to the second respondent along with a copy of the representation dated 11.06.2018 and other relevant documents and also a copy of this order.
7.This writ petition is disposed of with the above directions. No costs.
