3.M.Murugan ..Respondents Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the 1st and 2nd respondents to pay petitioners 1 to 3 Rs.20,000/- each and petitioners 4 and 5 Rs.25,000/- each as reimbursements for expenditure incurred for constructing houses together with interest and cost.

By consent, the writ petition is taken up for final disposal.

The petitioners and others claim that they are the natives of Thanzhanguda village, Cuddalore Taluk and District and it lies on the seashore and it was also one of the worst affected villages during Tsunami which devastated the coast of Tamilnadu during December 2004. Subsequently, the Government came forward to construct houses and the

construction was put up by the respondents 1 and 2 and the 3rd respondent is the Contractor. It is the specific claim of the petitioners that the 3rd respondent/Contractor did not perform his duty properly and therefore, they have to spend money out of their prospect to make the houses habitable and they submitted repeated representations to the respondent praying for reimbursement incurred by them on account of the shabby work done by the 3rd respondent and since no response is forthcoming, the petitioners have came forward to file this writ petition.

Heard the submissions of Mrs.P.Rajalakshmi, learned Government Advocate, who accepts notice on behalf of the respondents 1 and 2.

This Court, without going into the merits of the claim projected by the petitioners, directs the 2nd respondent to consider and dispose of the petitioners' representation dated 30.03.2015 in accordance with law after putting on notice the 3rd respondent and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner and to the persons concerned.

The writ petition is disposed of accordingly. No costs.
