This petition is filed to condone the delay of 383 days in filing the above Civil Miscellaneous Appeal.

2.The learned counsel appearing for the petitioner submitted that there is no relief sought against the 1st respondent and hence, notice to the 1st respondent may be dispensed with. Accordingly, notice to the 1st respondent is dispensed with.

3.Though notice was served on the respondents 2 & 3 and their names are printed in the cause list, there is no representation on behalf of them either in person or through counsel.

4.Mr.K.Vinod, the learned counsel takes notice for the 4th respondent/Insurance Company.

5.Being satisfied with the reasons stated in the supporting affidavit filed for condonation, the delay of 383 days is condoned and the petition is ordered.
