These petitions are filed (i) to condone the delay of 2260 days in seeking to set aside the abatement caused due to the death of the first respondent, namely, S.Venugopal (ii) to set aside the abatement caused due to the death of the first respondent and (iii) to bring on record the legal heirs of the deceased first respondent and rank them as respondents 5 to 9.

2. The learned counsel appearing for the respondents has no objection in allowing these petitions.

3. This Court is also satisfied with the reasons assigned in the affidavit filed in support of these petitions and in the facts and circumstances, the present petitions are allowed.

4. The Registry is directed to carryout the necessary amendments in the Second Appeal No.485 of 2008 and post the matter on 25.04.2019. 16.04.2019 (2/3) mbi http://www.judis.nic.in
