These petitions are filed (i) to condone the delay of 2260 days in seeking to set aside the abatement caused due to the death of the sole respondent, namely, S.Venugopal Naiker (ii) to set aside the abatement caused due to the death of the sole respondent and (iii) to bring on record the legal heirs of the deceased sole respondent and rank them as respondents 2 to 7.

2. The learned counsel appearing for the respondent has no objection in allowing these petitions.

3. This Court is also satisfied with the reasons assigned in the affidavit filed in support of these petitions and in the facts and circumstances, the present petitions are allowed.

4. The Registry is directed to carryout the necessary amendments in the Second Appeal No.484 of 2008 and post the matter on 25.04.2019. 16.04.2019 (1/3) mbi http://www.judis.nic.in
