ORDER
Alleging that the order of this Court dated 18.12.2025 passed in W.P(Crl.)No.1696 of 2025 has not been complied with, the present contempt petition has been filed.

The case of the petitioner in the writ proceedings is that she had sent a representation dated 15.10.2025 to the respondents 1 and 2 therein to take action against the respondents 3 to 5 therein for having assured her of getting allotment of two houses of Slum Clearance Board but subsequently reneged; since no action was taken by the respondents 1 and 2 on the representation of the petitioner, she had approached this Court in W.P.(Crl.)No.1696 of 2025 seeking a Writ of Mandamus directing the first respondent therein to dispose of her representation.

When W.P.(Crl.)No.1696 of 2025 had come up before this Court for hearing, it was represented that the representation of the petitioner given to the first respondent therein was forwarded to the second respondent therein for taking action and therefore, this Court, by order dated 18.12.2025, had directed the second respondent therein to consider the representation of the petitioner and pass appropriate orders on merits in accordance with law after issuing notice to the respondents 3 to 5 therein within four weeks from the date of receipt of a copy of the order.

Alleging non-compliance of the aforesaid order, the present contempt petition has been filed.

There is no representation for the contempt petitioner. 6.
The learned counsel for the respondent/State would submit that immediately after the receipt of the copy of the order dated 18.12.2025 passed in W.P.(Crl.)No.1696 of 2025, the respondent issued notice to the respondents 3 to 5 in W.P.(Crl.)No.1696 of 2025 under Section 94 of the Bharatiya Nagarik Suraksha Sanhita, 2023, on 21.12.2025 for appearance on 22.12.2025 and thereafter, due enquiry was conducted and statements were obtained from the petitioner as well as the respondents 3 to 5 and during enquiry, it came to light that the petitioner as well as Parthiban were cheated by one Raji, who, died in a road accident later. Unable to recover money from the said Raji, the petitioner has given a complaint against Parthiban for recovering the money. It also came to light that Parthiban is also one of the victims at the hands of Raji.
He would further submit that after obtaining opinion from the Legal Advisor, the complaint has been closed directing the parties to approach the Civil Court for proper remedy. Further, he would submit that the representation of the petitioner has been considered and the order of this Court has been fully complied with. However, he would submit that due to the time taken in summoning the witnesses and conducting the enquiry, there had been delay and he would submit that the respondent may be pardoned and absolved of the charge of contempt. He would further submit that the respondent will serve the copy of the report on the petitioner at the earliest.

Heard the learned counsel for the respondent/State and perused the records.

From the records, it is seen that the enquiry had been initiated by the respondent and after completing the enquiry, the complaint has been closed directing the parties to approach the Civil forum.
